POSITION

The Department opposes the bill.

PROBLEM/BACKGROUND

The Natural Resources and Environmental Protection Act, 1994 PA 451, as amended, authorizes the Department of Natural Resources to issue various permits and licenses.  Occasionally, applications for certain permits are denied.

DESCRIPTION OF BILL

SB 1183 proposes to amend 1994 PA 451, to create a new ‘Hunting and Fishing Board of Review’ to reexamine a decision of the Department to deny issuance of a permit or license.

The legislation is unnecessary as current language in Part 11 of Act 451, addresses appellate rights and such a review of decisions.  The Natural Resources Commission, at the request of a person with standing to challenge a final decision of the Department concerning permits or licenses, shall review the decision and make the final agency decision.
